Regulations of the contest / Giveaway on instagram under the name "Bundle of joy"

§1 General Provisions

1. It is the organizer of the Competition Petit Deko Sylwia Płoskonka with headquarters at ul. Słoneczna 21E, 32-005 Niepołomice with the NIP number 6831969161, REGON number 368382723, hereinafter referred to as the "Organizer". 
2. The competition is conducted on the terms described in these Regulations in accordance with the generally applicable provisions of Polish law. 
3. The competition starts on 06.12.2022/8.00/12.12.2022 at 23:59 and ends on 59/XNUMX/XNUMX at XNUMX:XNUMX. XNUMX:XNUMX:XNUMX Polish time.  

§2. Participants and rules of the Contest

1. Participation in the Competition is voluntary and free of charge.
2. The Contest may be entered by a natural person (consumer within the meaning of Article 22 of the Civil Code), hereinafter referred to as the Participant, who:
   1. read these Regulations and accepted its content and consented to the processing of personal data for the purpose of conducting the Competition by registering for the Competition; 
   2. is over 18 years of age and has full legal capacity;
   3. having an address for service on the territory of the Republic of Poland, 
   4. has a public account (profile) on Instagram, 
   5. will complete the Competition Task. 
3. Only a person meeting the conditions set out in §2 may be a Participant of the Competition. sec. 2 of the Regulations.
4. Employees of the Organizer and entities and employees of entities providing services to the Organizer in organizing the Competition on the basis of civil law contracts, as well as members of the immediate family (spouses, ascendants, descendants and siblings) of the above-mentioned persons are excluded from participation in the Competition.
5. In order to participate in the Contest, during its duration, the Participant will complete the Contest Task consisting of:

1. Adding a comment on the instagram profile of petitdeko (at https://www.instagram.com/petitdeko/) under the post of 06.12.2022 being the answer to the question: Where in your house (in whose room) will the Miffy First Light lamp be placed and to whom you would like to give it a smaller version and why. Tag this person on Instagram.

2. Adding a post informing about the contest/gift to your Insta Story 

6. Only Participants who complete the Competition Task during the Competition period will take part in the Competition. 
7.  The Participant may take part in the Contest only 1 (in words: one) time. 
8. The Organizer reserves the right to remove and not include in the Competition completed Competition Tasks whose authors:   

a) they do not act on their own behalf, but through third parties, 

b) operate from fictitious Instagram accounts/profiles;

c) create fictitious Instagram accounts/profiles; 

d) violate the rules of Instagram.

e) used in the Competition Task words commonly considered offensive, pornographic content, content promoting racial, ethnic and religious hatred or discriminating against social groups, violated the personal rights of third parties or the Organizer.

§3. Prizes and Selection of Winners 

1. The winners of the Contest will be selected by the organizer. The winners will be the people whose answers to the question asked the most captivate us. 
2. 3 (in words: three) Winners will be selected from among the participants. 
3. The winners of the Competition will be awarded the following prizes:
   1. 30st prize - MrMaria, a Miffy First Light lamp (XNUMX cm) and a mini lamp Miffy Bundle of Light.
   2. Second prize - Voucher for shopping in the store www.petitdeko.pl worth PLN 200 (say: two hundred zlotys)
   3. Prize III - Voucher for shopping in the store www.petitdeko.pl worth PLN 200 (say: two hundred zlotys)
4. Prizes are exempt from personal income tax pursuant to art. 21 sec. 1 point 68 of the PIT Act. 
5. To redeem the Cash Voucher for www.petitdeko.pl you should do shopping in the store in min. PLN 205. The voucher amount will be deducted on the shopping cart page. 
6. The winners of the Contest will be informed about receiving the Prize by posting a list of Winners indicating the names of the profiles (accounts) in the Organizer's Instagram profile on the @petitdeko profile by December 16.12.2022, XNUMX via Instagram Stories at the latest. The voucher is valid for six months from the date of its transfer. 
7. Information about winning the Contest will be sent to the Winners in a private message on Instagram.
8. The condition for receiving the Prize is that the Winner sends an e-mail to the Organizer within 14 days from the date of sending by the Organizer to the following address: [email protected] information necessary to transfer the Prize, including in particular: name, surname, e-mail address and correspondence address in the territory of the Republic of Poland. 
9. If the Winner fails to submit the 7 above, the data necessary to transfer the Prize, the Competition Commission will select the next Participant to receive the given Prize.
10. The Organizer is not responsible for failure to deliver the Prize to the Participant if the inability to deliver the Prize resulted solely from the Participant's failure to provide the data required to deliver the Prize or providing incorrect data or inconsistent with the Regulations.
11. Each Prize will be sent once by the Organizer to the address indicated by the Winner in the territory of the Republic of Poland within 7 days from the date of sending by the Winner in response to the information notifying about the awarded Prize all data enabling the shipment of the Prize.
12. The founder of the Awards is the Organizer. 
13. The winner may not transfer the rights to the awarded prize to a third party. 
14. The winner may waive the right to the Prize awarded to him by submitting a relevant written statement to the Organizer.
15. In the Contest, you can receive the Prize only 1 (in words: one) time.
16. The prize will be sent to the Participant at the expense of the Organizer. 
17. The Participant is not entitled to demand that the Prize be exchanged for a cash prize.

§5. Personal data

1. The administrator of the Participants' personal data is the Organizer. Contact with the organizer is possible by correspondence to the correspondence address Petit Deko Sylwia Płoskonka, ul. Słoneczna 21E, 32-005 Niepołomice and to the e-mail address [email protected]
2. The basis for the processing of personal data is art. 6 sec. 1 lit. a GDPR, Participants' consent to participate in the Competition and art. 6 sec. 1 letter f, i.e. the legitimate interest of the administrator, in particular in the scope of recognizing complaints and pursuing claims.
3. Participants' personal data will be processed to the extent and for the purpose necessary to conduct the Competition, select the Winners, consider possible complaints, and in the case of the Winners, also notify about the awarding of the Prize, issuing the Prize.
4. Providing personal data is voluntary, however, it is a condition for issuing Prizes to the Winners or submitting a complaint regarding identification and address data. 
5. Personal data will be stored for the duration of the Competition, and after its completion until any claims expire or the obligation to store data resulting from legal provisions expires, no longer than 5 years from the end of the calendar year in which the Competition was conducted.
6. The organizer exercises the rights of data subjects, i.e. access to their data and the right to rectify, delete, limit their processing, and the right to transfer data.
7. In the case of processing personal data on the basis of consent, the Participant has the right to withdraw consent at any time, and the withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. Withdrawal of consent requires electronic notification to the e-mail address: [email protected]
8. The recipients of the data are: entities providing hosting services, postal services, entities with which the Organizer cooperates as part of accounting and tax services, public authorities on the basis and within the limits of law, in particular KAS, law enforcement authorities. 
9. Personal data is not processed automatically and profiled. 

§ 6. Complaints

1. Participants of the Contest have the right to submit a written complaint with the note "Complaint: Giveaway: Bundle of Joy to the address  e-mail [email protected] up to 14 days after the end of the Competition or to the correspondence address: Petit Deko Sylwia Płoskonka, ul. Słoneczna 21E, 32-005 Niepolomice.
2. The letter containing the complaint should indicate the name and surname of the Participant and the correspondence address to which the response to the complaint will be sent.
3. The Organizer will provide the Participant with a response to the complaint within 14 days by registered mail sent to the address provided in the letter containing the complaint.
4. Negative consideration of the Participant's complaint by the Organizer does not exclude the Participant's right to pursue claims due to him under generally applicable provisions of law, including through court proceedings.

§7. Final provisions and technical information.

1. The Regulations enter into force on October 06.12.2022, XNUMX. 
2. The competition is not a promotional lottery within the meaning of Art. 2 clause 1 point 9 of the Act on games and mutual wagering of July 29.07.1992, 2004 (Journal of Laws of 4, No. 27, item XNUMX, as amended) and is not subject to the rules contained in the above-mentioned the act and executive regulations to this act.
3. The Organizer of the Competition is not responsible for the inability of a potential Participant to send the completed Competition Task for reasons attributable solely to the Participant.
4. The Rules of the Contest are made available during the Contest via the public ICT network Internet at the following URL: www.petitdeko.pl and in the Organizer's office.
5. The organizer undertakes to make every effort to amicably settle any disputes that may arise in connection with the conduct of the Competition. 
6. The court competent to settle any disputes is the court having territorial and material jurisdiction in accordance with the provisions of law.
7. This Contest is in no way organized, sponsored, conducted or endorsed by or associated with Instagram. 
8. The Organizer is solely responsible for conducting the Contest, and the Participants agree to release Instagram from any liability that may arise in connection with the organization of the Contest.  
9. A change to the Regulations requires publishing and informing the Participants about the changes made by the Organizer. Changes may be made only for reasons of adapting the Regulations to the standards of applicable law.
